How do you get money out of a personal injury lawsuit before the case settles?

The way to get cash out of a lawsuit before it settles is to use a company that will look at your case and see whether they like it enough to advance you some money on it now. It’s not really a loan in that you often don’t have to have good credit. The company only cares about how strong your lawsuit is. That is because that is where they are going to get their money back.

Why is it not a loan? It is not a loan because if the case does not payout, then you don’t have to pay back the advance. The fancy word for this is ‘non-recourse’ Whether the advance gets paid back is solely dependent on the case itself. So if the case settles then you pay the advance back. If the case goes to trial and you win, then you pay the advance back. If you lose the case and therefore get nothing from the lawsuit, then you do not pay the advance back.

There are good and bad sides to these legal action or settlement loans. These are advances that you should use only if you really need to. They can be costly ( We will talk about that in a minute ). However if you have got a strong case and you need to get yourself out of a financial mess or are just attempting to survive to the end of the lawsuit, then getting an advance might provide advantage to you. My warning to you. Don’t take too much as an advance. Take as little as you can.

These advances can be used for anything such as living expenses, car payments, medical costs and important debt expenses.

Will the loan change your lawsuit?

No way. Laws in many states protect you here. You and your lawyer still control the case and control whether to settle or take it to trial. The company is giving you money and taking the risk that it will get paid back later when the case settles. The loan company does not control your lawsuit.

These loans are expensive and the fees can add up quickly. The amount you pay back gets larger as more time goes by. The interest is accruing and sometimes very quickly. For this reason you should only take as little as you possibly can. Please take you time and consider your options carefully.
